This Disclosure Text has been prepared by Kiğılı Giyim Ticaret A.Ş. as the data controller within the scope of the Personal Data Protection Law (KVKK) No. 6698, to inform and enlighten you about which of your personal data will be processed for what purpose during your visit to our websites at https://www.abdullahkigili.com/, to whom and for what purpose this processed personal data may be transferred, the method and legal reason for our collection of your personal data, and the rights of the personal data owner ("relevant person") under Article 11 of the Law.

Processing of personal data: Any operation performed upon personal data, such as collection, recording, storage, preservation, alteration, reorganization, disclosure, transfer, acquisition, making available, classification, or blocking of use, wholly or partly by automatic means or non-automatic means as part of a data recording system,

Data Processor: A natural or legal person who processes personal data on behalf of the data controller based on the authority given by the data controller,

Data Recording System: The recording system in which personal data are processed by being structured according to certain criteria,

Data Controller: A natural or legal person who determines the purposes and means of processing personal data and is responsible for the establishment and management of the data recording system,

Law / KVKK: The Personal Data Protection Law No. 6698, published in the Official Gazette dated April 7, 2016, and numbered 29677,

Authority: The Personal Data Protection Authority,

Board: The Personal Data Protection Board.

 

3.        Your Processed Personal Data

During your visit to the website;

• Your IP address, which falls under the Transaction Security data category, 
• Your email address, delivery address information, and optionally your mobile phone number, which fall under the Sales Transactions category for your non-member purchases,
• Your name, surname, email, and phone number information if you opt for Kiğılı Card membership, which falls under the Marketing Transactions category,
• Your name, surname, mobile phone number, and personal data contained in the information, requests, and comments you transmit to us via the "Whatsapp Assistant" application, which you can connect to through our website,
• Your name, surname, email address, and optionally your phone number, along with personal data only shared by you in the information within the contact form, if you reach us via the "Contact Form" on our website at https://www.kigili.com/iletisim/ to submit your requests and complaints,
• Your name, surname, GSM number, email, store information where you made a purchase, and personal data you include in your requests within the form, if you reach us via the "Feedback and Suggestion Form" on our website at https://destek.kigili.com.tr/sizi-dinliyoruz,
• Your alteration form number or GSM number during inquiries you make from the alteration status inquiry screen on our website at https://destek.kigili.com.tr/urun-tadilat-sorgulama,
• Your GSM number when you inquire about your order status from the page https://destek.kigili.com.tr/siparis-sorgula on our website,
• Your name, surname, phone number, and the city and store information where you will be on the appointment date, when you create an appointment from the page https://destek.kigili.com.tr/akilli-alisveris on our website,
•  Your name, surname, email information, and personal data contained in your emails, sent via the email address info@kigili.com.tr provided on our website,
• Your name, surname, information regarding your experience in the applied position, phone number, CV, and personal data you include in the "description" section, if you fill out and submit the Kiğılı Career Journey Form on our website at https://corporate.kigili.com/kariyer-firsatlari or send your job application via email to  ik@kigili.com.tr which is also provided on our website. (Candidate Employee Disclosure Text) will be processed by Kiğılı Giyim Tic. A.Ş.

 

4.        Purpose and Legal Basis for Processing Personal Data

• Fulfilling official institutional requests and providing information to authorized organizations based on legislation, 
• Carrying out information and transaction security processes, 
• Monitoring and developing activities related to services, 
• Maintaining cybersecurity and data protection activities, 
• Following and executing legal affairs, 
• Storing website visit records for the general statute of limitations period to serve as evidence in disputes between us and the relevant individuals or against third parties, as the data controller.

 

2.        Legal Basis for Processing

• It is mandatory for the data controller to fulfill its legal obligation.
• Data processing is mandatory for the establishment, exercise, or protection of a right.
• Data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.

 

2.  Your personal data collected within the scope of Sales and Marketing Activities
   1.        Purpose of Processing;

• Issuing invoices for non-member purchases,
• Establishment of distance sales contracts, 
• To inform you about product supply and delivery processes,
• To ensure product delivery, and
• To ensure you benefit from member-specific prices in all these transactions for your member purchases.

 

2.        Legal Reason for Processing

• The necessity of processing personal data belonging to the parties of a contract, provided that it is directly related to the establishment or performance of the contract.
• It is mandatory for the data controller to fulfill its legal obligation.
• It has been made public by the data subject themselves.
• It is mandatory to process data for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.

 

3.  Your personal data processed when you contact our Company via the WhatsApp Assistant application on our Website, as well as in the Request and Complaint Form, Opinion and Suggestion Form, Contact Form, Smart Shopping Appointment Form, emails you send to our email address info@kigili.com.tr, and queries you make on the order and shipment status inquiry screen:

 

1.        Purpose of Processing:

• Processing customer requests and complaints to fulfill requests and evaluate complaints,
• Managing sales and marketing processes and providing personalized retail services,
• Providing customer support for issues such as order tracking,
• Planning and execution of operations aimed at customer satisfaction,
• Carrying out activities for service quality,
• Collecting, analyzing, evaluating information, preparing offers, policy approval, rejection, issuance, renewal, updating,
• If you have given consent, your identity, contact, customer transaction, and marketing data are processed for the purposes of recommending products and services offered by our Company customized to your preferences, usage habits, and needs, and sending commercial electronic messages such as advertisements, promotions, campaigns, and similar to your contact information within this scope.
• It is processed for the purposes of receiving, evaluating, and concluding your requests, questions, complaints, and suggestions.

 

2.        Legal Reason for Processing

• The necessity of processing personal data belonging to the parties of a contract, provided that it is directly related to the establishment or performance of the contract.
• It is mandatory for the data controller to fulfill its legal obligation.
• It has been made public by the data subject themselves.
• It is mandatory to process data for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.

 

4.  Your personal data included in job applications submitted via the Kiğılı Career Journey Form or by email to ik@kigili.com.tr
   1.        Purpose of Processing

• Evaluating your job application,
• Evaluating other positions you have applied for or that are suitable for your resume in accordance with Article 9 of Labor Law No. 4857,
• Carrying out human resources processes.

 

2.        Legal Reason for Processing

• Explicitly provided for in the laws.
• The necessity of processing personal data belonging to the parties of a contract, provided that it is directly related to the establishment or performance of the contract.
• It is mandatory for the data controller to fulfill its legal obligation.
• It has been made public by the data subject themselves.
• Data processing is mandatory for the establishment, exercise, or protection of a right.
• It is mandatory to process data for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.

 

5.        To Whom and for What Purpose Personal Data Can Be Transferred

Of your personal data, which Kiğılı Giyim Tic. A.Ş. declares and undertakes to process in accordance with the "General Principles" stated in Article 4 of Law No. 6698:

• IP information may be transferred to official institutions and organizations such as the Information and Communication Technologies Authority and the Chief Public Prosecutor's Office, if requested.
• Your personal data processed when you contact our Company via the Whatsapp Assistant application on our Website, as well as in the Request and Complaint Form, Opinion and Suggestion Form, Contact Form, Smart Shopping Appointment Form, emails you send to our email address info@kigili.com.tr, personal data in invoices and e-invoices, and personal data processed during queries you make on the order and shipment status inquiry screen are transferred to the Ministry of Commerce, the Personal Data Protection Authority, judicial and administrative authorities if requested, to our legal consultants to the extent necessary, to our cargo and logistics companies we work with for shipment tracking and delivery, to our suppliers, and business partners such as contracted tailors, and to our business partners providing technical infrastructure for sales and marketing activities and payment systems. Furthermore, although said data is not directly transferred abroad by Kiğılı Giyim Tic. A.Ş., it may be transferred abroad by intermediary service providers such as (but not limited to) Meta and Microsoft, which act as "data processors" on behalf of the Data Controller Kiğılı Giyim Tic. A.Ş. Kiğılı Giyim Tic. A.Ş. takes all necessary legal measures to ensure that personal data transfers made abroad by its business partners acting as data processors are carried out through one of the methods specified in Article 9/4 of the KVKK.
• Your personal data included in job applications submitted via the Kiğılı Career Journey Form or by email to ik@kigili.com.tr is not directly transferred abroad by Kiğılı, but may be transferred abroad via Microsoft, which acts as a data processor and hosts our email infrastructure. Domestically, it will only be transferred to authorized institutions and organizations upon request by authorized authorities within the scope of a judicial or administrative prosecution or investigation, and to our consulting law firm as much as necessary for the execution of legal processes such as termination of employment contracts, payment of compensation, and evaluation of re-employment requests. Apart from this, personal data of our employee candidates is not transferred to any third party or institution.

 

6.        Your Rights under Article 11 of the KVKK

As Kiğılı Giyim Tic. A.Ş., we inform you that you have the following rights under Article 11 of the KVKK:

1. To learn whether personal data is processed or not,
   
   
2. To request information if personal data has been processed,
   
   
3. To learn the purpose of processing personal data and whether they are used in accordance with their purpose,
   
   
4. To know the third parties to whom personal data is transferred domestically or abroad,
   
   
5. To request the rectification of incomplete or inaccurate personal data, to request the erasure, destruction, or anonymization of data in accordance with Article 7 of the KVKK if the reasons requiring the processing of personal data have ceased to exist,
   
   
6. To request that these operations regarding rectified, erased, destroyed, or anonymized data be notified to third parties to whom personal data has been transferred, if applicable,
   
   
7. To object to the emergence of an unfavorable result by analyzing the processed data exclusively through automated systems,
   
   
8. To request compensation for damages incurred due to unlawful processing of personal data.

 

7.        Application Procedure

In accordance with Article 5 of the Communiqué on the Procedures and Principles for Applications to the Data Controller dated March 10, 2018, to exercise the rights stated in Article 6 of this text, the Data Subject Application Form available on our website must be sent with the necessary identifying information of the applicant and your explanations regarding the right you wish to exercise, by registered mail with return receipt or via notary, with a wet signature, to the address: Aeropark Yenişehir Mah. Osmanlı Bulvarı No:11/B 34912 - Kurtköy - Pendik/İstanbul Turkey.

Applications must be made in Turkish; the request must be written with sufficient clarity to unequivocally understand which of the rights listed in Article 11 of the KVKK the request is based on; and identity information, as well as documents and information related to the subject, must be attached to the application. For applications made on behalf of third parties, a power of attorney suitable to represent the relevant person must be provided. Applications made within this scope will be concluded free of charge as soon as possible, and within a maximum of 30 days. However, if the process requires an additional cost, the fee specified in the tariff determined by the Personal Data Protection Board may be requested from you. In the event that the submitted information and documents are incomplete, this period begins from the date the information and documents are submitted in full. Our company reserves the right to verify your identity before responding to you. Responses may be sent in writing to the applicant's address via any type of mail or to the email address you have provided, at the discretion of Kiğılı Giyim Tic. A.Ş.

Kiğılı Giyim Tic. A.Ş. reserves the right to make changes to this illumination text due to possible amendments in the KVKK and methods to be determined by the Personal Data Protection Board.
